Civil Practice Division

The Civil Practice Division of the Administrative Office of the Courts coordinates the development and implementation of civil rules and improved court procedures and supports the local civil divisions in each Superior Court. Civil case types include small claims, which involve monetary damages of $3,000 or less and demands to return security deposits of $5,000 or less; special civil cases, which involve monetary damages of $15,000 or less; landlord/tenant disputes; and civil cases that have no monetary limit. The General Equity Part of the Civil Division resolves cases involving claims for non-monetary relief, such as injunctions, foreclosures, and disputes involving the governance of a corporation or partnership. The Surrogate Court handles certain limited jurisdiction cases such as adoptions, guardianships, and uncontested estate matters.
