Notice – Proposed Conclusion of Multicounty Litigation (MCL) Designation of HealthPlus Surgery Center Litigation – Comments or Objections Requested by December 30, 2022.

By Order of  December 2, 2019, the Supreme Court designated all New Jersey state court litigation alleging personal injuries resulting from lapses in infection control in sterilization/cleaning of instruments at the HealthPlus Surgery Center in Bergen County as multicounty litigation (MCL). The Court assigned this MCL to Judge Rachelle Harz in Bergen County for centralized management. Judge Harz has reported to the Administrative Director of the Courts that all state court litigation has been dismissed and that the MCL designation of the HealthPlus Surgery Center litigation therefore should be concluded.

Accordingly, pursuant to the provisions of Court Rule 4:38A and Directive #02-19, "Multicounty Litigation Guidelines and Criteria for Designation (Revised)," this Notice is to advise of the proposed conclusion of the MCL designation of the New Jersey state-court HealthPlus Surgery Center litigation.

Anyone wishing to comment on or object to this application should provide such comments or objections in writing, with relevant supporting documentation, by December 30, 2022 to:
