- Early Settlement Panels, The Early Settlement Program (ESP) provides mediation for divorcing couples. The goal is the help them reach an agreement on the terms of their divorce. ESP is an alternative to trial. Professional settlement coordinators run the program in each county. Settlement can shorten litigation time, save money, and ease some of the emotional burden of a divorce trial. For these reasons, it is in the best interest of the couple to try to settle their case at the ESP hearing. Under Court Rule 5.5-5 Court Rule 5.5-5 , judges can refer couples to ESP. When this happens, participation is mandatory. Both parties must submit their papers to the ESP coordinator and the panelists at least five days before the hearing date. Failing to do so could result in the case being dismissed or having the pay the other party’s legal fees.
