I am the tenant of a property that is being foreclosed upon, what do I have to do and what are my rights?
Legitimate residential tenants have the right to stay in the property even though the property is being foreclosed upon. Until ownership of the property changes or the tenant is otherwise informed by the court or mortgage holder, the tenant should continue to pay rent to the landlord. A tenant who wants to remain in the home can only be removed through a court process. The tenant may be protected by the New Jersey Anti-Eviction Act, which protects a tenant's right to remain in the property.
