NOTICE TO THE BAR
FAMILY-REVISEDNON-DISSOLUTION(FD)FINANCIALSTATEMENTFOR SUMMARY SUPPORT ACTIONS - FORM (CN 11223)
This notice announces amendments to the Non-Dissolution (FD) Financial Statement for Summary Support Actions form (CN 11223). The Supreme Court Special Committee on the Non-Dissolution (FD) Docket (Special Committee) recommended revisions to the form in its September 2022 report. As set forth in the August 9, 2023 notice, the Supreme Court approved the revisions.
The revisions ensure the exchange of accurate, updated financial information for the calculation of child support. They are also meant to ensure the disclosure of assets, liabilities, childcare costs, health care expenses, and require that supplemental information to support these expenses and other income information be attached.
The amendments are as follows:
- Part B - Gross Weekly Income-Added rental income; overtime, parttime, and severance pay; personal injury awards; and IRS Form 1040 Schedule sections.
- Part B - Gross Weekly Income-Removed "Social Security disability," as it is not considered income.
- Part C- Weekly Exemptions
- Line 1: Changed "tax exemptions claimed" to "eligible dependents," consistent with federal and state regulations regarding tax designations.
- Created separate lines for "Alimony paid" and "Child support paid."
- Added new section "Part H-Assets and Liabilities," consistent with the Special Committee's recommendation.
- Updated list of mandatory attachments consistent with the Special Committee's recommendation.
- Amended title of the form to include "Non-Dissolution (FD)."
- Simplified the instructions.
