Re: Civil Best Practices - Extension of Discovery by Consent

Under civil best practices, Rule 4:24-1(c) permits parties, "by written and filed consent", to extend the track-based
discovery period for an additional 60 days. In order to provide a standard procedure that will be followed uniformly in
all counties, the Conference of Civil Presiding Judges has agreed that the phrase "by written and filed consent" shall
require a consent order prepared by the parties and filed with the court. Such a consent order should ordinarily be filed
only at the end of the discovery period, after the TIS reminder notice has been sent and all parties are in the case.

Notices similar to this one will be published periodically, as the Conference of Civil Presiding Judges addresses issues
arising from the implementation and operation of civil best practices.
