RE: RULE 1:13-7 Dismissal Notices Dated January 28, 2001
Dismissal notices dated January 28, 2001 and sent in Law Division-Civil cases stated that the case captioned in the Notice would be dismissed for lack of prosecution pursuant to Rule 1:13-7 or Rule 4:43-2 unless action required under those rules is taken. The language of that notice was erroneous and should have stated that the dismissal was as to an identified* party or parties. The erroneous language was corrected in dismissal notices issued subsequent to January 28th. ONLY THOSE PARTIES NAMED ON THE "PARTY:" LINE OF THE JANUARY 28TH NOTICES WILL BE SUBJECT TO DISMISSAL.
